Juan Carols Martin Valenzuela missing - 41 year old hispanic male from Tucson Arizona

Juan Carols Martin Valenzuela has been missing since the end of May 2011.

My name is Sherri and we have a ten year old son together.

Juan Carlos has been caring for our son since June of last year 2010.

From what I gathered from his family (aunt and cousin) Juan Carlos said he was going to Willcox Arizona to find work, he never returned.

I know someone out there has either seen him or knows his whereabouts.

My little boy is very sad and is having a hard time not knowing what happened to his daddy. He has been getting nightmares and I am having trouble seeing my son because of his family, they are trying to keep him from me.

The description of Juan Carlos is 5'11 thin with dark brown hair and dark eyes. His d.o.b is January 24, 1969.

Your situation really seems messy...
Yep, if you were never married the mom has custody. Legally the aunt should not be the one to keep the child.

There was a similar case with a friend of mine in NY a while back. In that case the mother (anonymously) made something terrible up about the father (just to get the right to have the child living with her only).

But when the social worker came to the child's home to check on the situation (the child was living with the father most of the time), the social worker heard there was a custody twist and she immediately understood they were just false allegations.

Strange that the aunt could get away with the false allegations so easily. You should try to figure out what she said and go to court.

I hope you find the strength to get your son to live with you, somehow.

His aunt has been lying to me since May. I had no idea that Juan has been missing this long, until I started asking why he is never there when I call my son.

After a while they just wouldn't answer the phone, well finally when I told her I knew something was not right, that I am gonna go get my son because I think there is something she isn't telling me. Then she finally said hes been gone for 4 weeks (at the time). She said "I don't want to keep your baby from you but if you want him to stay for one more school year so u can get on your feet I'm okay with that", I said "I will call u wed. to let you know". Of course she never answered when I called and no one ever tried to make contact with me.

Finally when I did make contact she said I am not allowed to have any contact with my son, so I went out to Arizona, went straight to the police and they said I am the one who has custody because we were never married, so when I went to get him some dumb ass cop told me I had to leave. I was never shown any paperwork of anything, I was not contacted on any changes of anything, his aunt went to CPS and made false allegations on me and no one even tried to verify anything with me.

So now I am fighting to get him back, that's why she has him.

Sherri, I'm so sorry for you... I really hope someone who can help you will see your post.

But I think the most important thing now would be to get your ten year old son back. At least if you feel you are capable of taking care of him and want him to live with you.

What are the things you could do to get him back?

The way I see it, if your son does not live with his father anymore, you as the mother should be the next natural caregiver, not your son's fathers aunt...

It does not sound fair (maybe not even legal), that Juan Carols Martin Valenzuela's aunt is trying to keep you from seeing your own son.
